NO PURCHASE NECESSARY. A PURCHASE, PAYMENT, OR DONATION WILL NOT INCREASE ANY NOMINEE’S CHANCES OF BEING SELECTED AS A FINALIST OR WINNER. VOID WHERE PROHIBITED BY LAW.

These Official Terms and Conditions govern the Donovan’s CARes Vehicle Giveaway (“Giveaway” or “Program”), sponsored by Donovan’s Auto & Tire Center (“Sponsor,” “Donovan’s,” “we,” “us,” or “our”). By submitting a nomination, accepting a nomination, participating as a finalist, voting, or accepting the awarded vehicle, each participant agrees to be bound by these Official Terms and Conditions and by the decisions of Sponsor, which are final and binding in all matters relating to the Program.

1. Purpose of the Program

Donovan’s CARes is a community-focused vehicle giveaway intended to recognize and support a deserving individual who demonstrates need, character, community impact, personal hardship, service to others, or other meaningful circumstances as determined by Sponsor.

The Program is not a lottery, raffle, sweepstakes, or game of chance. Finalists are selected based on nomination materials and Sponsor’s review criteria. The final recipient is selected through a public voting process from among the finalists.

2. Sponsor

This Program is not sponsored, endorsed, administered by, or associated with any social media platform, media company, vehicle manufacturer, insurance provider, government agency, or third-party website unless expressly stated by Sponsor in writing.

3. Eligibility

To be eligible to receive the vehicle, a nominee must:

  1. Be a legal resident of the United States.
  2. Be at least 18 years of age at the time of vehicle transfer.
  3. Be legally able to own, register, insure, and operate a motor vehicle, or otherwise arrange lawful ownership, registration, insurance, and transportation of the vehicle.
  4. Possess a valid government-issued photo identification.
  5. Be able to satisfy all requirements necessary to transfer title, register the vehicle if applicable, and maintain legally required insurance or proof of financial responsibility.
  6. Be willing to complete all required paperwork, releases, tax forms, title documents, and related documentation requested by Sponsor.
  7. Be available to participate in reasonable publicity related to the Program, unless prohibited by law.
  8. Not be an employee, officer, director, owner, or immediate family member of an employee, officer, director, or owner of Donovan’s Auto & Tire Center, its affiliated companies, advertising agencies, promotional partners, judging panel members, or any other party directly involved in administering the Program.

For purposes of these rules, “immediate family member” includes spouse, parent, child, sibling, grandparent, grandchild, in-law, or any person living in the same household, whether related or not.

Sponsor reserves the right to require proof of eligibility at any time. Failure to provide requested proof may result in disqualification.

4. Nomination Period

The nomination period begins on July 27, 2026 and ends on August 9, 2026

Nominations received before or after the official nomination period may be disqualified. Sponsor’s computer, website platform, email system, or other designated timekeeping method shall be the official timekeeping device for the Program.

5. How to Nominate Someone

To nominate an individual, the nominator must complete the official nomination form available at https://www.donovantire.com/donovans-cares/ and provide all required information, which may include:

  • Nominator’s name and contact information.
  • Nominee’s name and contact information, if known.
  • Explanation of why the nominee is deserving.
  • Description of the nominee’s transportation need.
  • Any relevant community involvement, hardship, service, employment, family circumstances, or other supporting information.
  • Confirmation that the nominator has permission, where appropriate, to share the nominee’s story and contact information.

Limit one nomination per nominater. Multiple nominations for the same individual may be considered but do not guarantee selection as a finalist.

Incomplete, inaccurate, false, offensive, fraudulent, automated, or inappropriate nominations may be disqualified at Sponsor’s sole discretion.

6. Nominee Consent

Sponsor may contact nominated individuals to confirm their willingness to participate. A nominee is not required to accept participation. If a nominee declines, cannot be reached, does not respond within the timeframe provided by Sponsor, or cannot satisfy eligibility requirements, Sponsor may disqualify that nominee and select an alternate.

By agreeing to participate, each nominee confirms that:

  1. The information submitted about them is accurate to the best of their knowledge.
  2. They are willing to be considered publicly as a finalist.
  3. They understand that portions of their story, name, likeness, image, voice, general location, and nomination details may be used in connection with Program promotion.
  4. They understand that being nominated or selected as a finalist does not guarantee receipt of the vehicle.

7. Finalist Selection

Following the nomination period, Sponsor will review eligible nominations and select up to six finalists.

Finalists may be selected based on criteria including, but not limited to:

  • Demonstrated transportation need.
  • Personal, family, employment, educational, medical, or community circumstances.
  • Positive impact on others.
  • Character, perseverance, service, or generosity.
  • Completeness and sincerity of the nomination.
  • Sponsor’s assessment of the nominee’s ability to lawfully accept, title, insure, and maintain the vehicle.

Finalist selection is subjective and will be made at Sponsor’s sole discretion. Sponsor is not required to disclose individual scores, judging notes, deliberations, or reasons for selecting or not selecting any nominee.

Sponsor reserves the right to select fewer than six finalists if fewer eligible or suitable nominations are received.

8. Public Voting

Once finalists are announced, the public may vote during the official voting period, which begins on August 12, 2026 and ends on August 18, 2026.

Voting will take place at https://www.donovantire.com/donovans-cares/.

Unless otherwise stated by Sponsor, voting is limited to one vote per email address.

Sponsor reserves the right to monitor voting activity and to disqualify votes that appear, in Sponsor’s sole discretion, to be fraudulent, automated, duplicate, manipulated, purchased, incentivized, generated by bots or scripts, or otherwise inconsistent with the spirit of the Program.

Prohibited voting activity includes, but is not limited to:

  • Use of bots, scripts, macros, automated voting tools, or vote-exchange systems.
  • Paying for votes or offering compensation, gifts, prizes, or anything of value in exchange for votes.
  • Creating fake accounts or false identities.
  • Using VPNs, proxy servers, disposable emails, or other methods to manipulate vote counts.
  • Harassing, threatening, defaming, or intimidating other finalists, voters, Sponsor, or Program participants.

Sponsor may remove votes, adjust vote totals, suspend voting, change voting methods, extend or shorten the voting period, or select a winner by alternate means if Sponsor determines that the integrity of the vote has been compromised.

9. Winner Selection

The eligible finalist receiving the highest number of valid public votes, as determined by Sponsor, will be selected as the potential recipient of the vehicle.

The potential recipient is subject to verification of eligibility, completion of required paperwork, and satisfaction of all transfer requirements. The potential recipient is not the official winner until Sponsor confirms eligibility and all required documents have been completed.

In the event of a tie, suspected vote manipulation, finalist disqualification, inability to complete transfer requirements, or other issue affecting the integrity or completion of the Program, Sponsor reserves the right to determine the recipient using one or more of the following methods:

  • Review by Sponsor or a judging panel.
  • Selection of the finalist with the strongest nomination based on Sponsor’s criteria.
  • A runoff vote.
  • Selection of an alternate finalist.
  • Any other fair method determined by Sponsor.

Sponsor’s decision is final.

10. Vehicle Award

The vehicle is awarded as-is, with no substitutions, cash alternatives, or exchanges, except at Sponsor’s sole discretion.

Sponsor may, but is not required to, perform certain repairs, maintenance, detailing, inspections, or safety checks before transfer. Any such work does not create any warranty, guarantee, or ongoing service obligation unless expressly provided in writing.

11. As-Is Vehicle Disclaimer

The recipient acknowledges and agrees that the vehicle is provided AS IS, WHERE IS, WITH ALL FAULTS, except for any written warranty that may be expressly provided by Sponsor or a third party.

To the fullest extent permitted by law, Sponsor makes no warranties, representations, or guarantees, express or implied, regarding the vehicle, including but not limited to:

  • Condition.
  • Safety.
  • Roadworthiness.
  • Reliability.
  • Mechanical performance.
  • Future repair needs.
  • Fuel economy.
  • Fitness for a particular purpose.
  • Merchantability.
  • Resale value.
  • Availability of parts.
  • Insurance cost or insurability.
  • Compliance with the recipient’s personal, family, employment, or transportation needs.

The recipient is solely responsible for inspecting the vehicle, asking questions, and determining whether to accept the vehicle.

Acceptance of the vehicle is voluntary. If the potential recipient does not wish to accept the vehicle as offered, Sponsor may select an alternate recipient.

12. Title, Registration, Insurance, Taxes, and Fees

Sponsor will cover the following costs associated with the vehicle transfer:

  • Ohio Title Transfer fee
  • First year Registration

Unless expressly stated otherwise in writing, the recipient is solely responsible for all other costs and obligations associated with accepting, owning, registering, insuring, maintaining, storing, repairing, and operating the vehicle, including but not limited to:

  • Insurance or proof of financial responsibility.
  • Registration.
  • License plates.
  • Emissions or inspection requirements, if any.
  • Taxes, including any applicable federal, state, local, income, gift, use, or other taxes.
  • Future repairs and maintenance.
  • Fuel.
  • Towing.
  • Parking.
  • Tickets, fines, tolls, violations, or impound fees.
  • Any costs required because of the recipient’s license status, driving record, insurance history, residence, or personal circumstances.

The recipient must provide proof of legally required insurance or financial responsibility before taking possession of the vehicle, if required by law, Sponsor, title office, registration office, or any other applicable authority.

The recipient must cooperate in completing title transfer and related paperwork. If the recipient cannot complete the title transfer, obtain required insurance, provide required identification, satisfy legal requirements, or take possession of the vehicle within 7 days after notification, Sponsor may disqualify the recipient and select an alternate.

Sponsor is not responsible for any inability of the recipient to obtain insurance, maintain insurance, register the vehicle, obtain plates, obtain financing for related expenses, or lawfully operate the vehicle.

13. Tax Reporting

The value of the vehicle may be taxable to the recipient. The recipient is solely responsible for determining and paying any taxes resulting from acceptance of the vehicle.

Sponsor may require the recipient to complete a Form W-9, affidavit of eligibility, liability release, publicity release, tax acknowledgment, or other documentation before the vehicle is transferred. Sponsor may issue an IRS Form 1099 or other tax documentation if required by law.

The recipient should consult their own tax advisor regarding the tax consequences of accepting the vehicle.

14. No Cash Alternative or Substitution

The vehicle may not be exchanged for cash, credit, services, repairs, gift cards, a different vehicle, or any other item of value.

Sponsor reserves the right, in its sole discretion, to substitute a different vehicle or prize of equal or greater approximate value if the advertised vehicle becomes unavailable, is damaged, is sold, is determined unsuitable, or cannot be awarded for any reason.

15. Transfer Deadline and Forfeiture

The potential recipient must complete all required documentation and take possession of the vehicle by August 28, 2026 unless Sponsor agrees in writing to extend the deadline.

Failure to complete required paperwork, provide requested documentation, obtain insurance, complete title transfer, appear for scheduled appointments, or take possession of the vehicle by the deadline may result in forfeiture.

If the vehicle is forfeited, Sponsor may select an alternate recipient or may cancel the award entirely.

16. Publicity Release

Except where prohibited by law, by accepting finalist status or accepting the vehicle, each finalist and recipient grants Sponsor and its designees the right to use their name, likeness, photograph, video, voice, biographical information, city/community of residence, nomination story, statements, and Program-related content for advertising, publicity, social media, website, press release, video, radio, print, and promotional purposes without additional compensation, notice, review, or approval.

Sponsor may edit nomination stories or participant statements for length, clarity, grammar, privacy, legal compliance, or promotional use, provided Sponsor does not intentionally misrepresent the substance of the story.

17. Privacy

Information submitted in connection with the Program may be used to administer the Program, contact nominators and nominees, verify eligibility, conduct finalist selection and public voting, promote the Program, and comply with legal obligations.

Sponsor may publish finalist names, photos, stories, vote-related content, and winner information. Sponsor will not intentionally publish sensitive personal information such as Social Security numbers, driver’s license numbers, insurance policy numbers, home addresses, or financial account information.

Participants should not submit confidential medical records, financial records, legal documents, or other sensitive information unless specifically requested by Sponsor through a secure method.

18. Content Rights and Nomination Materials

By submitting a nomination, the nominator represents that:

  1. The nomination is truthful to the best of their knowledge.
  2. They have the right to submit the nomination.
  3. The nomination does not knowingly violate another person’s rights.
  4. The nomination does not contain false, defamatory, obscene, threatening, harassing, discriminatory, or unlawful content.
  5. Any photos, videos, or materials submitted are either owned by the nominator or submitted with appropriate permission.

By submitting a nomination, the nominator grants Sponsor a perpetual, royalty-free, worldwide right to use, reproduce, edit, publish, display, distribute, and create derivative works from the nomination materials in connection with the Program and Sponsor’s related promotional activities.

Sponsor is not obligated to use, return, preserve, or acknowledge any nomination materials.

19. Disqualification

Sponsor may disqualify any nominator, nominee, finalist, voter, or potential recipient at any time if Sponsor determines, in its sole discretion, that the person:

  • Violated these Terms and Conditions.
  • Submitted false, misleading, incomplete, or fraudulent information.
  • Is ineligible.
  • Cannot legally accept, title, register, insure, or take possession of the vehicle.
  • Engaged in vote manipulation or other improper conduct.
  • Harassed, threatened, defamed, or abused Sponsor, employees, finalists, voters, or other participants.
  • Damaged the integrity, fairness, reputation, or intended purpose of the Program.
  • Failed to respond to Sponsor within the required timeframe.
  • Failed to complete required paperwork.
  • Refused or failed to sign required releases or acknowledgments.

Sponsor’s decisions regarding disqualification are final.

20. Voting Integrity and Technical Issues

Sponsor is not responsible for lost, late, incomplete, misdirected, delayed, corrupted, inaccessible, or failed nominations or votes due to technical issues, internet outages, platform errors, software failures, website problems, email filtering, spam folders, data loss, unauthorized access, human error, or any other cause.

Sponsor does not guarantee that the nomination or voting website will be uninterrupted, error-free, secure, or available at all times.

If technical failures, fraud, tampering, unauthorized intervention, or any other cause affects the administration, security, fairness, or proper conduct of the Program, Sponsor reserves the right to modify, suspend, cancel, extend, or terminate the Program, or to determine the recipient in a manner Sponsor deems fair and appropriate.

21. Release of Liability

By participating in the Program, each nominator, nominee, finalist, voter, and recipient agrees to release, discharge, indemnify, and hold harmless Donovan’s Auto & Tire Center, its owners, officers, employees, agents, representatives, affiliates, advertising and promotional partners, vendors, insurers, successors, and assigns from and against any and all claims, demands, losses, damages, injuries, liabilities, costs, and expenses arising out of or related to:

  • Participation in the Program.
  • Nomination, finalist selection, public voting, or winner selection.
  • Acceptance, transfer, ownership, possession, use, misuse, maintenance, repair, storage, registration, insurance, or operation of the vehicle.
  • Any vehicle defect, breakdown, accident, injury, death, property damage, traffic violation, insurance issue, tax issue, title issue, or legal issue.
  • Publicity, photography, videography, social media posts, interviews, or use of a participant’s name, likeness, story, or statements.
  • Technical failures or voting irregularities.
  • Disqualification or forfeiture.
  • Any act or omission by any participant, voter, third party, government agency, title office, insurer, repair facility, or other entity.

The recipient assumes all risk associated with accepting, owning, possessing, maintaining, and operating the vehicle after transfer.

22. Indemnification

Each participant agrees to indemnify, defend, and hold harmless Sponsor from any claims, losses, damages, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of that participant’s breach of these Terms and Conditions, false statements, improper conduct, violation of law, infringement of third-party rights, or misuse of the Program.

23. No Guarantee of Outcome

Nomination does not guarantee finalist selection. Finalist selection does not guarantee receipt of the vehicle. Receiving the most public votes does not guarantee receipt of the vehicle unless the finalist satisfies all eligibility, verification, documentation, insurance, title, transfer, and legal requirements.

Sponsor reserves the right not to award the vehicle if Sponsor determines that no eligible finalist can lawfully or appropriately accept it, if the Program is compromised, or if awarding the vehicle would violate applicable law or the intent of the Program.

24. Compliance with Laws

The Program is intended to comply with applicable federal, state, and local laws and regulations. Participants are responsible for complying with all laws applicable to them.

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

25. Governing Law

The Program and these Terms and Conditions shall be governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

Any disputes arising out of or related to the Program shall be resolved exclusively in the state or federal courts located in Hamilton County, Ohio, unless otherwise required by law.

26. Program Changes or Cancellation

Sponsor reserves the right to modify, suspend, cancel, or terminate the Program at any time for any reason, including but not limited to fraud, technical issues, legal concerns, vehicle availability, safety concerns, insufficient eligible nominations, reputational concerns, force majeure events, or circumstances beyond Sponsor’s control.

Sponsor also reserves the right to interpret these Terms and Conditions and make all decisions regarding Program administration in its sole discretion.

27. Important Notices

This Program is designed as a community recognition program and vehicle giveaway. It is not intended to be a raffle, lottery, gambling activity, or paid-entry sweepstakes.

No purchase, payment, service appointment, donation, review, referral, or other consideration is required to nominate, be nominated, vote, become a finalist, or receive the vehicle.

Donovan’s Auto & Tire Center does not provide legal, tax, insurance, or financial advice. Participants and the recipient should consult their own advisors regarding legal, tax, insurance, registration, and financial obligations.
